Terms of Service

1. Acceptance of Terms

By accessing or using Homeo Companion ("the Service", "the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

These Terms constitute a legally binding agreement between you ("Doctor", "User") and Homeo Companion ("we", "us", "the Company"), operated by the owner(s) of homeocompanion.in.

2. Eligibility — Doctors Only

This platform is exclusively for registered homeopathic practitioners. To use Homeo Companion you must:

• Hold a valid BHMS (Bachelor of Homeopathic Medicine and Surgery) degree from a recognised institution
• Be registered with a recognised State Homeopathy Council or the National Commission for Homoeopathy (NCH)
• Have a valid, current registration number
• Be practising as a homeopathic doctor in India

Registering on behalf of another person, using a borrowed or rented registration number, or misrepresenting your qualifications is strictly prohibited and constitutes fraud.

3. Registration & Verification

During registration you are required to provide:

• Your full legal name (as on your registration certificate)
• Your State Council registration number
• Name of your state homeopathy council
• BHMS college and graduation year
• A clear photo/scan of your State Registration Certificate
• A valid WhatsApp number

All submitted documents are reviewed by our admin team. We reserve the right to cross-verify your registration with the NCH portal (nrh.nch.org.in) and respective state council records. Providing false or forged documents may result in:

• Permanent account suspension
• Reporting to the relevant State Medical/Homeopathy Council
• Legal action under BNS Section 234 (forgery of valuable security, will, etc.) — punishable by up to 7 years imprisonment
• Reporting to the National Commission for Homoeopathy

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Ensuring that only you (the registered doctor) use this account
• Notifying us immediately if you suspect unauthorised access

Sharing your account with unregistered practitioners, assistants, or third parties to practice homeopathy under your license is a violation of these Terms and may constitute professional misconduct.

5. AI-Assisted Clinical Tools — Disclaimer

Homeo Companion uses artificial intelligence (Gemini 2.5 Flash, Groq Llama) to assist with clinical case-taking and remedy suggestions. You must understand the following:

• AI suggestions are for professional reference only and do not constitute a final medical diagnosis or prescription
• The treating doctor bears full clinical and legal responsibility for every prescription issued
• AI-generated content may contain errors — always apply your professional judgement
• Do not share AI consultation transcripts with patients as official medical advice
• The platform references classical Materia Medica but this does not replace clinical examination

6. Patient Data & Privacy

Patient data stored through Homeo Companion is:

• Stored securely in Google Firebase (Firestore) with encryption in transit and at rest
• Accessible only to the registered doctor who created the records
• Images uploaded via Cloudinary are stored on Cloudinary's secure servers
• You are responsible for obtaining patient consent before recording their information
• You must comply with applicable Indian data protection laws

7. Subscription & Payments

• Subscription plans are billed monthly (Standard ₹2,050 / Pro ₹5,125 / Enterprise ₹10,250)
• All prices include GST where applicable
• Payments are processed via Razorpay; by paying you agree to Razorpay's terms
• Subscriptions auto-renew unless cancelled before the renewal date
• No refunds are issued for partial months
• We reserve the right to change pricing with 30 days notice
• Trial accounts are limited to 5 consultations

8. Prohibited Use

You must not use Homeo Companion to:

• Practise medicine without a valid registration
• Allow unregistered persons to use your account to treat patients
• Attempt to reverse-engineer, scrape, or copy the platform
• Upload harmful, illegal, or fraudulent content
• Use the AI for purposes other than homeopathic clinical assistance
• Resell or sublicense access to the platform

9. Termination

We may suspend or terminate your account at any time if:

• You violate these Terms
• Verification documents are found to be false or forged
• Your registration with the state council is revoked or expired
• We receive a complaint from the NCH, a state council, or law enforcement
• Your account is inactive for 12+ months on a free/trial plan

10. Limitation of Liability

Homeo Companion is provided "as is" without warranties of any kind. We are not liable for:

• Clinical outcomes resulting from AI-assisted suggestions
• Data loss due to technical failures beyond our control
• Interruptions to service due to maintenance or force majeure
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the subscription fees paid by you in the 3 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India. By using the platform you consent to this jurisdiction.

12. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance. We will notify you of material changes via email or in-app notice.
